  • Merchants: Businesses that subscribe to Yuko to manage reviews, loyalty programs, referrals, and memberships;
  • End Users: Customers of merchants who interact with Yuko-powered features;
  • Visitors: Individuals who visit the Yuko website or access publicly available content.

 

1.3 This Policy is incorporated into and forms part of:

  • The Yuko Terms and Conditions (for merchants);
  • The Yuko End User Terms of Service (for end users);
  • The Yuko Enterprise Service Agreement (for enterprise customers).

 

1.4 By using the Service, you agree to comply with this Policy. Violation of this Policy may result in suspension or termination of your access to the Service.

2. GENERAL PRINCIPLES

2.1 You must use the Service in a manner that is:

  • Lawful: Compliant with all applicable laws and regulations;
  • Ethical: Honest, fair, and respectful;
  • Responsible: Considerate of other users, merchants, and Yuko;
  • Secure: Protective of the integrity and security of the Service.

 

2.2 You must not use the Service in any way that could harm, disable, overburden, or impair the Service or interfere with any other party’s use of the Service.

3. PROHIBITED CONTENT

3.1 You must not upload, submit, transmit, or otherwise make available through the Service any content that:

Illegal Content

(a) Violates any applicable law, regulation, or legal requirement;

(b) Infringes any intellectual property rights, including copyrights, trade marks, patents, or trade secrets;

(c) Violates any privacy or publicity rights;

(d) Constitutes or facilitates illegal gambling, illegal drugs, or other illegal activities;

(e) Promotes or facilitates human trafficking or exploitation.

Harmful Content

(f) Contains viruses, malware, spyware, or other malicious code;

(g) Is designed to disrupt, damage, or limit the functionality of any system;

(h) Contains phishing attempts or fraudulent schemes;

(i) Promotes or provides instructions for dangerous or harmful activities.

Offensive Content

(j) Is defamatory, libellous, or slanderous;

(k) Is obscene, pornographic, or sexually explicit;

(l) Promotes violence, terrorism, or hatred against individuals or groups;

(m) Is discriminatory based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics;

(n) Harasses, bullies, threatens, or intimidates others;

(o) Is abusive, vulgar, or gratuitously offensive.

Deceptive Content

(p) Is false, misleading, or fraudulent;

(q) Impersonates any person or entity;

(r) Misrepresents your identity or affiliation;

(s) Contains fake reviews, fake testimonials, or fraudulent endorsements;

(t) Is designed to deceive or manipulate users.

Inappropriate Content

(u) Contains personal or confidential information of others without authorisation;

(v) Is spam, unsolicited advertising, or promotional material;

(w) Is irrelevant or off-topic to the intended purpose;

(x) Contains excessive profanity or adult language in inappropriate contexts

4. PROHIBITED ACTIVITIES

4.1 You must not engage in any of the following activities:

System Integrity

(a) Attempting to gain unauthorised access to the Service, accounts, systems or networks;

(b) Circumventing, disabling, or interfering with security features;

(c) Reverse engineering, decompiling, or disassembling any part of the Service;

(d) Probing, scanning, or testing the vulnerability of the Service;

(e) Interfering with or disrupting the Service, servers, or networks;

(f) Overloading, flooding, or crashing the Service.

Data and Privacy

(g) Collecting, harvesting, or scraping user data without authorisation;

(h) Using automated systems (bots, crawlers, scrapers) without permission;

(i) Accessing data not intended for you;

(j) Violating the privacy of other users;

(k) Breaching data protection or privacy laws.

Account Abuse

(l) Creating multiple accounts for deceptive purposes;

(m) Sharing accounts or login credentials;

(n) Using another person’s account without authorisation;

3Commercial Misuse

(q) Using the Service for purposes other than intended;

(s) Using the Service to compete with Yuko;

(t) Using the Service to develop competing products;

(u) Sublicensing or providing access to unauthorised third parties.

Review and Rating Manipulation

(v) Submitting fake reviews or ratings;

(w) Offering incentives for reviews without proper disclosure;

(x) Suppressing or manipulating negative reviews improperly;

(y) Using the Service to attack competitors through fake reviews;

(z) Gaming or manipulating review algorithms or display systems.

Loyalty and Referral Fraud

(aa) Fraudulently earning, redeeming, or transferring loyalty points;

(bb) Creating fake accounts to exploit loyalty programs;

(cc) Self-referring or creating fake referrals;

(dd) Exploiting bugs or errors in loyalty systems;

(ee) Manipulating loyalty balances or transactions.

5. MERCHANT-SPECIFIC REQUIREMENTS

5.1 In addition to the general requirements, merchants must:

Customer Communications

(a) Comply with all applicable anti-spam and electronic communications laws;

(b) Obtain proper consent before sending review requests or marketing com

munications;

(c) Honour opt-out and unsubscribe requests promptly;

(d) Not send deceptive or misleading communications;

(e) Not use the Service to send unsolicited bulk messages.

4Review Management

(f) Not selectively solicit reviews only from satisfied customers in a deceptive manner;

(g) Not offer inappropriate incentives that may compromise review authenticity;

(h) Not suppress legitimate negative reviews improperly;

(i) Clearly disclose when reviews are incentivised;

(j) Not edit or alter the substance of customer reviews without consent.

Loyalty Program Operations

(k) Operate loyalty programs fairly and transparently;

(l) Honour earned rewards as promised;

(m) Provide clear terms and conditions to customers;

(n) Comply with all applicable laws regarding loyalty programs;

(o) Not operate programs in a manner that misleads customers.

Data Protection

(p) Process customer data in compliance with applicable privacy laws;

(q) Obtain proper consent for data collection and use;

(r) Implement appropriate security measures;

(s) Comply with the Yuko Data Processing Agreement;

(t) Not use customer data for purposes beyond those permitted.

6. END USER-SPECIFIC REQUIREMENTS

6.1 In addition to the general requirements, end users must:

Review Submissions

(a) Only submit reviews based on genuine experiences;

(b) Be honest and accurate in review content;

(c) Disclose any incentives received for reviews;

(d) Not submit reviews on behalf of others without disclosure;

(e) Not submit multiple reviews for the same purchase/experience.

Program Participation

(f) Participate in loyalty and referral programs honestly;

(g) Not create multiple accounts to exploit programs;

(h) Not make fraudulent referrals;

(i) Comply with merchant program terms;

(j) Not attempt to manipulate point balances or rewards.

7. SECURITY REQUIREMENTS

7.1 All users must:

(a) Maintain the security and confidentiality of login credentials;

(b) Use strong, unique passwords;

(c) Enable additional security measures where available;

(d) Report security vulnerabilities responsibly to [email protected];

(e) Not exploit security vulnerabilities;

(f) Notify Yuko immediately of any suspected security breach;

(g) Not share API keys, tokens, or other authentication credentials

8. COMPLIANCE AND REPORTING

8.1 Your Responsibility: You are responsible for ensuring your use of the Service complies with this Policy and all applicable laws.

8.2 Reporting Violations: If you become aware of any violation of this Policy, please report it to:

9. MONITORING AND ENFORCEMENT

9.2 Investigation: Yuko may investigate suspected violations of this Policy and cooperate with law enforcement authorities.

9.3 Enforcement Actions: If Yuko determines that you have violated this

Policy, we may take one or more of the following actions:

(b) Remove or disable access to violating content;

(c) Temporarily suspend your access to the Service;

(d) Permanently terminate your access to the Service;

(e) Report violations to law enforcement;

(f) Take legal action against you;

(g) Pursue any other remedies available at law or equity.

9.4 Discretion: Yuko has sole discretion in determining whether a violation has occurred and what action to take.

9.5 No Liability: Yuko shall not be liable for any action taken in accordance with this Policy

10. CONSEQUENCES OF VIOLATION

10.1 Violation of this Policy may result in:

(a) Loss of access to the Service;

(b) Forfeiture of loyalty points, rewards, or benefits;

(c) Termination of your account and agreement;

(d) Legal action and liability for damages;

(e) Reporting to law enforcement authorities;

(f) Public disclosure of violations where appropriate.

10.2 Merchant Consequences: Merchants who violate this Policy may also face:

(a) Immediate suspension of the Service;

(b) Termination of the subscription agreement;

(c) Forfeiture of prepaid fees;

(d) Liability for damages caused by the violation

11. INTELLECTUAL PROPERTY COMPLAINTS

11.1 DMCA/Copyright: If you believe content on the Service infringes your copyright, please submit a notice to:

(a) Identification of the copyrighted work;

(b) Identification of the infringing material and its location;

(c) Your contact information;

(d) A statement of good faith belief that the use is not authorised;

(e) A statement under penalty of perjury that the information is accurate;

13.1 Yuko may update this Policy from time to time. We will notify users ofmaterial changes by:

(a) Posting the updated Policy on our website;

(b) Updating the “Effective Date” at the top of this Policy;

(c) For merchants, notifying via email or the Service dashboard.

13.2 Your continued use of the Service after changes constitutes acceptance of

the updated Policy.
